TERMS & CONDITIONS
GUIDELINES TO AND LIMITS OF SERVICE

Role
This document defines the role and scope of services that Lumiere Productions Limited provide. Typically this includes the design lighting, video content or other visual elements for a project, along with the specification and programming of the equipment to control it.
The information to be supplied by the Client prior to Lumiere Productions commencing work on the project shall include:

  • Brief
  • Budget
  • Programme
  • Clients invoice payment requirements and protocol
  • Purchase order number if applicable
  • List of the design team

Services
The lighting proposal is based on the services as laid out below and is divided into stages one to five. The Lighting Designer (or other designer as nominated by Lumiere Productions) will carry out all these stages in order unless otherwise agreed with the client and only move onto the next stage when approved.

Stage One – Preliminary Services

  • Formulation of feasibility and/or design reports.
  • Attend preliminary meetings with the Client and other members of the design team.
  • Assist others with the preparation of the budget.
  • Assist others with project planning and development of the brief.

Stage Two – Concept Design

  • Attend meetings with all relevant members of the design team
  • Produce presentation materials as determined by Lumiere Productions to convey the overall lighting (or other) design.
  • Produce preliminary equipment schedule.
  • Attend briefing meetings with the client and/or their project manager.
  • Carry out conceptual design studies.
  • Attend concept design presentation to the Client.

Stage Three – Scheme Design

  • Attend meetings with all relevant members of the design team
  • Develop Lighting Design.
  • Prepare preliminary layouts of the proposed scheme.
  • Prepare preliminary equipment schedule
  • Prepare preliminary control strategy
  • Prepare preliminary calculations

Stage Four – Detailed Design & Production

  • Attend meetings with all relevant members of the design team.
  • Assist with the coordination of the scheme (including with regard to the building fabric, structure and electrical services).
  • Prepare final layouts of the proposed scheme based on CAD files provided (DWG, DXF, WYSIWYG)
  • Prepare final equipment specification
  • Provide final details where applicable for incorporation into the construction details.
  • Prepare final specification for the control system.
  • Comment on the final coordinated construction drawings, specifications and details of the scheme as provided by others.
  • Carry out risk assessment based on Lumiere Productions’ design information in accordance with the requirements of The Construction (Design & Management) Regulations 1994 and BS7909 as appropriate.

Stage Five – Construction, Focusing, Programming and Final Commissioning

  • Attend contract site meetings with all relevant members of the design team.
  • Comment on contractors and/or manufacturers drawings.
  • Carry out final review of the installation on site.
  • Direct the focusing and final co-ordination of installed scheme where applicable on site.
  • Direct the programming of installed control equipment where applicable on site.
  • Assist design team, the contractor and any other relevant parties in preparation schedules of defects related to items specified by Lumiere Productions.

The client may at any time with reasonable written notice instruct the Lighting Designer (or other suitable person as nominated by Lumiere Productions) to undertake additional services.
The following items are excluded from the services, but can be provided for additional fees upon request and may, in some cases be subcontracted to another company who specialise in the field in question:

  • Special renderings, 3D computer generated or animated images and any other visual presentation elements other than those determined by the Lumiere Productions for the purposes of conveying the design intent.
  • Sunlight / daylight studies including the hire of testing facilities, construction of models etc.
  • Design, supervision of construction, testing and evaluation of mock ups and/or models.
  • Detailed summary reports and/or plots showing luminance levels other than those deemed necessary by Lumiere Productions for the general evaluation of the design.
  • Design & development of custom fixtures and negotiating and obtaining competitive prices for such items.
  • Review and checking of substitute fixtures proposed by others for design compliance.
  • Shop and field inspections
  • Whole life cost and running cost reports
  • Final equipment schedule for Clients building maintenance staff.

Lumiere Productions’ services do not include the following:

  • Architectural Services such as the design and production of fully coordinated drawings, specifications for any aspect of the architectural design including mechanical fixings, exact methods of fastening or connecting lighting or other equipment to the fabric of the building, identification and/or design of builders work or any other service or by the Architects appointment and plan of work unless otherwise stated.
  • Structural Engineering Services including the design and production of fully coordinated structural drawings, or any service or item of work defined by the Structural Engineers appointment and plan of work unless otherwise stated.
  • Electrical Engineering Services such as the coordination with existing power or ventilation systems, associated builders work, the coordination of the projects lighting with other building or services systems or item of work defined by the Electrical Engineers appointment and plan of work unless otherwise stated.

It is normally preferred that clients should engage all subcontractors directly, however, where requested, Lumiere Productions may (using subcontractors and external suppliers) provide equipment hire, rigging, transport and crew services. In such cases agreement must be reached with clients prior to production on the limits and extents of responsibilities and liabilities of Lumiere Productions, subcontractors and the contracting client.

 

Copyright and Intellectual Property

Unless otherwise agreed copyright and all intellectual property rights for any lighting, visual or other design and all elements thereof will remain the sole property of Lumiere Productions Ltd and the Lighting Designer responsible for designing the production.

Copyright of a design may be purchased only with prior agreement. This condition supersedes any other contract or agreement except where specifically agreed and stated. In engaging Lumiere Productions clients are agreeing to this condition.

 

Payment

For theatrical productions payment should be made in two parts, the first in advance at an agreed date, the second on the morning of the opening night of the production. In other cases, unless otherwise stated, the following will apply:

Unless otherwise agreed, payment should be made in full within 30 days of date of invoice. Any delay in payment beyond agreed terms may be subject to penalty payments (normally 10% per week overdue).
Unless otherwise agreed in advance a Purchase Order should be provided to Lumiere Productions before production begins.
Unless otherwise stated (in advance of production commencing), it will be assumed and agreed that the most recent estimate provided has been accepted and as such payment to that amount will be honoured.
It is understood that expenses may arise over and above those estimated, as such these will be agreed and honoured in payment by the client.

Projects outside Ireland and UK will be subject to additional terms and conditions, which will generally include up to 50% advance payment.

It is understood that in engaging Lumiere Productions Ltd, that all clients accept and will abide by the terms and conditions above, unless otherwise stated prior to engaging Lumiere Productions.
